FUNDAMENTAL FOUNDATIONS OF CONCESSION AGREEMENTS IN THE TRANSPORT SYSTEM

A B S T R A C T

The purpose of the research is to investigate the forms of concession agreements, as well as the legal and institutional mechanisms of their application in the transport system within the framework of the public-private partnership (PPP) business model, and to identify opportunities for their effective implementation based on a comparative analysis of international experience.

The methodology of the research - the study is based on scientific abstraction, comparative analysis, synthesis and generalization, as well as systematization of international and national legal documents, analysis of practical cases of concession projects, and descriptive analysis.

The practical importance of the research - the results provide practical value for planning concession projects in transport infrastructure, organizing tender procedures, optimizing risk allocation, and increasing investment attractiveness. The findings can be applied both in governmental decision-making processes and in strategy development by potential concessionaires.

The results of the research - the study identifies the advantages and disadvantages of various concession models (BOT, BOOT, BTO, BOO, Brownfield, and perpetual concession), compares Latin American and European approaches, and systematically analyzes the stages of tendering procedures, the criteria for selecting concessionaires, and the socio-economic impacts of projects.

The originality and scientific novelty of the research lie in the analysis of the perpetual concession model as a flexible mechanism for adapting to economic changes, in highlighting its role in balancing stakeholder interests, and in evaluating its potential for application in Azerbaijan. The article also provides a theoretical and methodological justification of the principles of strategic planning, transparent evaluation, and effective risk management in the implementation of concession projects.
